Estate Planning: Whether you need a simple will or a complex trust, we can assist you. We take into consideration your goals, tax planning and estate planning needs when we provide these services.

Revocable Living Trust: The primary purpose of a revocable living trust is to avoid probate and is a substitute for a will. A revocable living trust is a legal document that, like a will, provides instructions for distribution of your assets when you die. But, unlike a will, a revocable living trust avoids probate, can control all of your assets, and can prevent court control of your assets in the event of incapacity. Usually, administrative fees and costs are much less than a probate and distributions can be made much sooner and without resort to, or control, by a court.

Probate: Probate is a court supervised process for distributing your property which is not only expensive, but may take from nine months to over a year (or longer) before your estate can be distributed to your heirs. Your privacy is also lost in that the provisions of your will and what you own, and what you owe, become public record that virtually anyone can have access to. If you do not have a revocable living trust, and you die with or without a will, probate is usually necessary.

Transactional: We can draft and review contracts and agreements relating to the operation of a business, including leases, purchase and sale agreements and buy-sell or cross-purchase agreements.

Entity Formation: We can provide you with an evaluation of what type of business entity is best for you, including partnerships, corporations, limited liability companies, or sole proprietorship. Once this has been determined, we can draft the necessary business formation and operating documents that may be appropriate. We are available to give continuing advice as the business continues to grow including business reorganizations, acquisitions and mergers, sales and liquidation.

Jack D. Brown is a member of The Traynor Society, Scholastic Honor Organization of the University of the Pacific, McGeorge School of Law, and graduated in the top five percent of his class in 1975.

In 1976, he joined the firm of Rich, Fuidge, Marsh & Morris Inc., in Marysville, California and became a partner in 1979. During that period of time, he did general trial work, but was primarily involved in business formation, transactional work and estate planning.

In 1981, Mr. Brown formed a partnership with Thomas Hill under the firm name of Brown & Hill Inc. His partner handled personal injury and general litigation matters. At that time, Mr. Brown did a significant amount of general trial work as well, but continued to emphasize business formation, transactional matters, estate planning and probate, and developed a substantial trust practice.

Mr. Brown’s partner was appointed a Superior Court Judge in 1988. For the next three years he practiced as a sole practitioner with one associate. In 1989, his practice was merged into McDonough Holland & Allen located in Sacramento, California and he became a shareholder of that firm.

After joining McDonough Holland & Allen, Mr. Brown de-emphasized the business litigation aspects of his practice and placed greater emphasis on business matters, estate planning, probate, trusts and trust administration.

Early in 2002, Mr. Brown established his present practice in the Murrieta-Temecula area and limits his practice to general business matters, estate planning, probate, trusts and trust administration.
